Speaking at the Uttar Pradesh National Law University foundation-laying ceremony here, the CJI said: “In 1975, it was Justice Jagmohanlal Sinha of the Allahabad High Court which rendered the ruling that shook the nation, when it disqualified Srimati Indira Gandhi. It was a very courageous trial, arguably the direct result of the declaration of emergency. The consequences of which I do not want to elaborate now, ”Judge Ramana said.
The CJI said the Allahabad High Court has a history of more than 150 years and its Bar Association has produced some of the greatest legal luminaries in the country.
Then-Prime Minister Indira Gandhi had won Rae Bareli’s 1971 Lok Sabha elections by defeating her opponent Raj Narain. The defeated leader had challenged her election by alleging bad electoral practices. His petition to the HC led to Gandhi’s disqualification.
