NEW DELHI: In the midst of a new confrontation between the Supreme Court and the Center on the latter affirming the right to reject names recommended by panels led by SC judges for court appointments, CJI NV Ramana warned of contempt proceedings and said that in a democratic country governed by the rule of law under the Constitution, the government cannot say that it will not accept these recommendations.
The court, also composed of judges DY Chandrachud and LN Rao, accused the Center of carefully selecting from the list of persons recommended by search and selection committees headed by sitting Supreme Court justices for appointment to the courts and read the riot law to the Attorney General KK Venugopal.
It read: “Make all appointments within two weeks and give reasons for rejecting names recommended by selection panels. We will hold hands for two weeks at the start of contempt proceedings. Give us a complete picture of appointments and vacancies. “.
The sound and fury of the court accompanied by the threat of contempt forced the government to step back from office and promise through the attorney general that it was prepared to consider all the names recommended by the selection panels, including those that have not been fixed. However, at the AG’s request, the CV agreed to give the government two weeks to fill the vacancies with names already recommended by the selection panels.
“We are granting the last two weeks. Please come with a full appointment and a vacant position with letters of appointment. The attorney general ensures that all appointments of the recommended names will be made within two weeks. If no one is appointed , the government will give the reasons. Ready after two weeks, “said the SC in its order.
In detailing its complaint, the CJI-led bank noted that of the 41 names recommended by the selection panel for Income tax appeal court, only 13 have been appointed by the government and that also by selection.
