Judge G Narendra’s order is expected to be issued on Friday.
As Judge Narendar sought to know if the US-based Twitter Inc could be considered a parent company, Maheshwari’s attorney CV Nagesh said: “Twitter Inc is a parent company.
We have absolutely nothing to do with it (Twitter Inc).
It (Twitter India) is an independent organization and institution. ”
When the judge asked about the promoters and participation patterns of Twitter India, Nagesh said that Twitter India is only an affiliate company of Twitter Inc.
Later, the judge pointed out that there is no affiliated company.
In normal terms, it is called a sister or associate company, depending on the shareholding and the articles of incorporation.
To this, Nagesh said “Let me put it on the record that Twitter US (Inc) does not have a single share on Twitter India. That is why I say it is a totally different entity. ”
Q Prasanna Kumar, a lawyer for the Ghaziabad police, said Twitter Inc will face “consequences for saying they don’t know who Twitter India is.”
Kumar said: “My instructions are that 99 percent of the shares of the company belong to Twitter Inc.”
“All of the petitioner’s colleagues have been representing Twitter India, as well as Twitter Inc before central government agencies, even to this day,” Kumar said.
He argued that “unless Twitter India officials were connected to each other,” the Twitter Inc. board would not have authorized its Twitter India employees to represent before central government agencies.
Judge Narendar held that the board of directors can authorize anyone.
During the discussion, Nagesh offered to record a memo on Friday that Twitter USA is not even a shareholder.
Explaining the pattern of stock holding, he said that the International Twitter Company, based in Ireland, has 9,999 shares, while Twitter Netherlands has one share.
However, it is Twitter Inc who runs the platform.
The Ghaziabad (Uttar Pradesh) police had issued a notice under Section 41-A of the CrPC on June 21, asking Maheshwari to report to the Loni border police station at 10:30 am on June 24. .
He then moved to the Karnataka High Court as he lives in Bengaluru in Karnataka.
On June 24, the high court, in an interim order, prevented the Ghaziabad police from initiating any coercive action against him.
Judge Narendar had also held that if the police wanted to examine him, they could do so through virtual mode.
On June 15, Ghaziabad Police booked Twitter Inc, Twitter Communications India Pvt. Ltd. (Twitter India), the news website The Wire, journalists Mohammed Zubair and Rana Ayyub, as well as Congress leaders Salman Nizami, Maskoor Usmani, Shama Mohamed and writer Saba Naqvi.
